What is wrong with the country today? People invest their lifetime, sometimes two or three, for THEIR property, and the government can come in and say, okay, get out we want townhomes or malls. No wonder the farmers around here have been selling out, but looks like New Jersey government officials have decided it is better to steal peoples property, and most likely sell for less to developers who may just promise "better".

Me, if I lived near this lady, would walk up and say, hey, ma'am, I'm with ya, sit tight and fight hard, and by the way, while I am behind ya, and given government powers that will block my beach access, mind if I wet a line, or two?

Guess a man's, or woman's home is no longer their "castle". Just flat out wrong! And, sorry, not sure Marylands stand, but greedy is becoming greedy, and what's mine, well, apparently, AIn'T :--|

Of course it is wrong, such property confiscation runs entirely at odds to the fundamental principles of private property this nation was founded upon. These abuses of the takings clause of the 5th Amendment have been a natural byproduct of the federal judiciary's drift away from our fundamental constitutional principles.

The Supreme Court’s 5 - 4 decision in Kelo v. City of New London last year is what has empowered these towns to act on private property they wish to transfer into development just to enhance their tax base (or reward political cronies). The vote was as follows:

MAJORITY- Stevens, Kennedy, Souter, Ginsburg, Breyer.
DISSENTING- O'Connor, Rehnquist, Scalia, Thomas.

Hopefully this issue is not settled, the public outcry over Kelo v. City of New London and the many state legislature’s responses to it will certainly generate more legal action. Hopefully with the new structure of SCOTUS they will a) decide to hear the right case and b) decide it in a constitutional manner.

If memory serves me right where they built the new Bass Pro Shop in Hampton, Va. they TOOK a few folks homes this way. The one man fought very hard to keep his home that had been in his family for around 100 years, he had gone down and gotten a court to put a stay on it but they bull dozed it anyway. So not only did they have to pay him bucks for his home but they pissed the judge off and he gave the man another million to boot. Of course US city tax payers will have to foot that bill but I just hope the city may have lerned a lesson.

I feel if the land is being taken so that some may stuff their pockets that the land owner gets a big cut of what the land becomes worth not what they say it is worth at that time. Just maybe if they are forced to split the profit with the land owner they might go look else where or find someone more willing to sell.

Just remember you own nothing, if ya don't believe me just don't pay your taxes :eek:

Some people upset with the decision of the Supreme Court found a way to voice their disapproval. Well, one guy started with a plan and it's grown into a pretty good size movement that still gets press coverage.

The town were Justice Souter lives has three "councilmen" or "trusties". They applied for the right to take his house and turn it into a "Lost Liberty Inn". From what I originally heard, they only have to get 2 of the 3 to agree the Inn will increase the tax base of the house or get a majority of the residents to vote for the house to be turned over during an election. I doubt they will win, but I sure hope it causes some concern for Justice Souter.

Hey Sarge, sorry, probably should have posted in the Lounge area, and yes, it seems to be happenning everywhere, just, this one hit the Jersey shore, so my apologies.

Yeah Rob, hopefully, yet doubtfull, it will work, maybe then they will realize the impact of their decision.

The way I see it is governments can take everyone's property, turn them into townhomes owned by private developers, who are most likely either paying off elected officials, or at the least, contribute to their campaigns for personal gain, the ordinary citizen will own nothing, and keep less. :--|

Here in th Jersey Shore area, Wildwood, Cape May...we have the same problem. However.....The island.....Wildwood, Wildwood Crest and North Wildwood passed city ordinaces which unfourtunately protect the business owner. What they did is this.....depending on your location, if have a bar or resturant or hotel and you sell....a bar, resturant or hotel must be rebuilt in its place if you are going to rebuild. They realized this because During the month of September after the season you have the Firemans convention, Bike week, Monster Truck rally, Irish Festival, etc not to mention the VFW, Moose, and Elk conventions. With all of the condos goin up and hotels coming down they would stand to lose a boat load of money. Why would you spend $1,000-$1500.00 per day to stay in a condo which you have to take care of for a week end when you are here to have a good time. Now with the Miss America pagent not in Atlantic City anymore this opens the door for those conventions to go else where. As we all know money talks and BS walks.

The goverment of New Jersey should be ashamed of itself, I can say this because I was born there and understand how corrupt and unethical the politicians are there in New Jersey. I moved out in '92 and saved myself money and have a better lifestyle in Va. Others are doing the same. This woman has a right to live where she wants and she should be able to keep her home no matter what. The money hungry devolopers in N.J. make me vomit.:--| :--| :--|
