So I was perusing eBay today, and came across a new in box Stradic 2500FH. It was on sale as a Buy It Now for $4.99. Yep, that's not a type, $4.99. I immediately bought it, and now the seller if refusing to go through with the deal, refunded my money, and will not answer any more of my messages. He says it was a mistake on his part, that he was interrupted while posting the item, and not I'm more or less SOL. I've escalated it through PayPal, but do you guys think I'm being unreasonable? The item was there, fair game. I paid for it right away and did everything according to what you're supposed to do.

if you asnwer yes, then go after him. if you answer no, then let it go.

As much as it would tick me off, yes I would honor it. I've bought and sold a ton of stuff on eBay. If I've ever made a mistake that was my own fault, I did everything I could to fix it and make the seller happy. At the same time, I'm kind of leaning towards fingerandclaws...it is the Holidays, and I know I won't ever see the reel. I think I need to sleep on it and decide tomorrow.

I have bought and sold thousands of dollars worth of golf clubs on EBAY, and have ran into the very same scenario more than a few times. Usually it turns out to be a "typo" by the seller.
I always email them first to be absolutely sure.
A tiny bit of diplomacy can go a long ways on EBAY. I just had a guy from a sale that I made 10 years ago wishing me a Merry Christmas. I sold him a putter that was identical to what his dad used when he was growing up.
99.9% of the people you deal with on EBAY are good folk. There are some dicks, but this one sounds like a honest mistake. I can't tell you what to do, but I'd give him a break and not slam him on the buyers reviews.

with the majority here, let it go.
If it had been a big conglomerate that could easily suck up the loss I might feel different. I once got a set of golf clubs at a store that was mis-priced, but it was only a hundred off on an 800 dollar set of clubs. (marked at 700)
Would I have asked them to honor it if they had labeled it at $80 instead of $800 ? I don't think that I could reasonably have expected them to honor that, even tho they might have capitulated if I raised enough fuss.
I think I would have felt extremely guilty about taking advantage of an honest mistake.

You have 20 days to recocile the issue if he has allready refunded your Money you are SOL what was the guy's ebay rating ...outside of that you can leave him a negative. Although it sounds like an Honest mistake on the sellers part.

Obviously the guy made an honest mistake. Have a laugh about it and let it go. Negative feedback isn't necessary either.
I once was given several packs of large Owner hooks that I didn't need so I put them on eBay. One bidder put a reserve bid on the hooks but he put the decimal point in the wrong place. Then another bidder who was brand new to eBay and something of an idiot started bidding on the hooks. This new guy was determined to win the bid so he kept on upping the ante. The final bid on three packs of hooks that retailed for around $10 was $72.00!
Turns out the guy who entered the sky high bid by accident was a teaching professor at Johns Hopkins medical center. We had a laugh about the whole situation, we came to an agreement on a reasonable price for the hooks, PLUS my eBay fees and we both went away happy.
And my point in telling this story is that we all make mistakes, even professors at major medical schools. Why push the issue and create more problems, have a laugh and move on.

He may have intended to have 4.99 as the starting price on a regular style auction and not intended for it to be Buy it now. Ebay has steps inplace to protect both buyers and sellers from there own stupidity such as typos If you had accidentally typed in $499 as a bid then you would have been able to retract it based on their policy. Also Buyers have the choice to cancel an item or someones bid at anytime so I doubt there is much you can do so dont worry about go find another reel to bid on there are plenty out there.

Hmmm, interesting situation.
1. You did no wrong.
2. He admitted fault and refunded your money.
I personally would pat myself on the back and forget about it . . . it's the holiday season. What if he was in business and needed that income instead of losing a bunch of money or some poor kid who wanted to sell it to make some cash to buy his girlfriend a necklace.
Either way, your not gonna get that Stradic for $4.99 no matter what you do . . . I think the only thing you could do is leave negative feedback if you feel the need. Let it go, it's the holidays!!! :D

It's one thing to get lucky on a deal, however it's a bit unethical to claim that the counter party has no right to remedy a mistake, and must honor it irregardless of the circumstances.
Fact is if you know an object is worth $499.00 and think you are entitled to get it at a mere fraction of the value because of a typo, you are kidding yourself.
What do you think a retail outlet is going to do ? Eat the loss? not likely- they'll find a way to pass the loss on to other consumers, so in essence your only hurting fellow shoppers- then again I sense its an "all about me Attitude"
so what do you care if someone gets financially hurt, damaged, maybe even fired, long as you recieve the benefit you did nothing to earn ?
Sorry, a little preachy, but it strikes a nerve.

Mark it's not often that I disagree with you, but if a $499.00 item in a retail, bricks and mortar store has the pricetag of $4.99, by law they have to honor it. How long was it on Ebay before you got it? That part is probably unknown, but Im sure it was long enough for the owner to review, which obviously he neglected to do. The apparent attitude of the seller is the main reason Id pursue. Not knowing exactly how, and with emotion and character distorted over the internet through text, it's not clear of the seller's attitude. From what basstardo said, the guy was being a jack-@$$ ...so I'd go after it. Had the seller reacted differently and kept responding to emails, Id have dropped the issue. This is just what Id do, right or wrong.

It's not a generation. It happens young and old. It's about the seller's attitude in my opinion, had he been nicer, I woulda let it go if I was basstardo, but for some reason everybody over looked that and jumped to persue it or let it go, not HIS attitude.

There are a lot of good opinions here, and I've got thoughts leaning towards both sides. The biggest problem I have is the guy stopped talking to me. If he would have at least kept an open channel of conversation, there wouldn't be a second thought about this, I would have let it go. I have now tried to contact him 4 separate times, through both eBay and PayPal. The more the guys keeps blowing me off, the more I get ticked off. :mad: His first couple of messages before he stopped talking were pretty snidely worded as well.

How many times have you emailed him ... If he won't sell it for $5 and refunded your money there isn't alot else to talk about ....
Did he offer you the reel at a more reasonable price ... or credit or anything else ....
Found this reading the reg's ... it pertains more to the buyer but seems like it would too if the seller made a mistake
fail to deliver payment for items purchased by you, unless the seller has materially changed the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity;

I'll have to differ in opinion on the store issue. While most stores might honor an incorrect price tag on an item- the law says they are under no obligation to do so. THe price tag does not represent a leagally binding offer- it is defined legally as an "invitation to trade", this includes newspaper and magazine advertisements, store window displays, price tags on merchandise,and prices in catalogs, all fall in this category.
No sale is executed until a customer makes an offer to buy at the specified price, - AND the seller accepts the offer of that price in exchange for the merchandise.
If a store does honor an incorrect price, they are doing so out of fear of bad publicity, and under small mistakes may suck up the loss, but they under no obligation to do so.
Worth remembering if they refuse to honor an obviously mismarked item- stomp out of the store po'ed if you like, but they are within their rights in refusing to make the sale.

Sorry Shooter- that's a different situation
- if you give a specific individual a "quote" that can likely be held as a legally binding offer to an individual, it's different than an "invitation to trade" with the public at large.
There's a legit reasonm why the incorrect price does not "have" to be honored. If I as a car dealer take an ad out selling new cars for $29,000, but the ad is misprinted by leaving a zero off ( $2900), the law recognizes I would be out of buisness in a hurry if forced to honor the "mistake". Some unscrupulous businesses may try to get you in the door by advertising something at a low price intentionally and then claiming its a "mistake" or that they are out of the advertised item (bait and switch). These are the businesses I'd be refusing to deal with, not the honest Joe making an honest mistake. It may at times be difficult to distinguish between the two- and this is where I agree in part with Treed- if the seller acts like a real jerk I may refuse to do further business with him, but nothing much I can do about forcing him to honor an incorrect price.

Absolutely! I have NEVER had a store refuse to honor a mispriced item where the store had marked the price. I have had a couple of times where a customer appeared to have moved a price tag from one item to another. I understood and did not complain.
It's all about customer service. A good store who values their customers will treat their customers right. Even if a store loses $100 on a sale, it would be wise to honor the price tag or sign. Why? The lifetime value of a good customer is much greater than the money lost. If you don't match the price, you risk ruining the relationship with the customer and thus the future value of that customer's profit stream.
Your attitude reflects the attitude I have often heard of in small time stores ran by small time owners. Not the kind of place I'm going to shop at very often anyway.
I'm taken by surprise that you think this is an "all about me" issue. Some of the best stores out there, see Nordstroms, will honor a return from a customer knowing the customer did not purchase the item at Nordstroms, even knowing Nordstroms does not sell the item. I had a professor who used to be a Nordstroms exec tell us the story of a lady, who owned a Nordstroms credit card and was a regular shopper, who came in demanding a refund on a sweater. She said she paid $100 but didn't have the receipt. The customer service agent knew it was a brand they didn't even sell. What did they do? They gave the lady $100 and donated the sweater to some charitable organization.

Thanks Husky, I've had to go thru all those present value calcs myself, your right, not really exciting stuff. I can appreciate your opinion, and I can understand a store not wanting to take a publicity hit on an error if they can live with it.
The problem is it dosen't take long for people to start to demand that they're legally entitled to benefit from someones mistake, since it is so often seen as common practice. Then they want to get bent out of shape and act outraged, because they perceived they have been wronged, when in fact they haven't.
All I'm saying is if a seller is willing to honor a mistake, more power to them. But am I going to demand satisfaction , if they are unwilling. NO.
I have no legal basis to expect them to "Have" to honor the mistake.
Using the threat of taking future business elsewhere to attempt to coerce them into honoring a mistake may be common- but a bit unethical in my book.
Remember, it boils down to you "knowingly" taking advantage of someone elses mistake. If push comes to shove- your wrong for doing so- both from a moral and legal standpoint.

That said, I don't think a consumer has any way of knowing for certain if the price is correct or not. Many times items that were once expensive are clearanced out. You never know why a store might mark something down.
That said, it is certainly obvious in the case of the reel that started this thread. And it would be obvious if say a Nintendo Wii was marked 39.99.

That's an interesting take, just two days ago I called a counterparty that my firm does business with and informed them they had underbilled us to the tune of $850,000 on the previous months invoice.
The total invoice was for a bit over $13 million, so maybe if I had said nothing it would have gone unnoticed, and saved my firm the $850,000.
Would this have been right ? Had they found out later could I say too bad- you billed me incorrectly- your fault- I paid you what you asked for so tough cookies?

I will and do patronize small businesses that don't act like small businesses. The ones that succeed, make a profit, and become the large businesses that get the best prices from vendors ARE the ones who will eat cost to make a customer happy.
Example, I am in your restaurant eating a salad. I find an aephid. I ask to speak to the manager. I politely show him the bug (because I COULD be loud and rude and make sure the entire restaurant knows there was a bug in my salad). How he reacts is what determines whether I ever come back.
If I get a halfhearted apology, I politely pay the bill and leave - never to return. I he sincerely apologizes and says my meal is on the house, I am a customer for life (as long as I don't keep having bugs in my salad).
Just because I do not own a small business does not mean I don't know how they should be run. I've take entrepreneurial classes and listened to many a successful businessman discuss his early beginnings.

i made a mistake on a job estimate a few months ago..contract was written and job was half done. i had forgotten to charge for one part of the job, even though it was stated ont he contract. i simply contacted the homeowner showed them my numbers and the homewoner wrote me another check. thank god there are good people out there...

I don't see how this has ANYTHING to do with it. You and your client agreed to certain terms of payment. Those are the terms that should met. When you go to a store the only terms you know is the price on the tag or the sign. If you then take the product to the register and they say "oh, that's the wrong price, it's $30 more than the price tag", who is being dishonest? The store is. They advertise the price by the price tag.

Sure, but those are risks you know of and assume when you become a small business owner. I spent many a year in business school (bachelor's and MBA). Enough to decide that I preferred the stability of working for someone else. I wanted to have kids and have good health insurance etc. I chose not to assume the risks of working for myself. Sometimes I am happy with that decision and sometimes I dream bigger. Having been to FNC's house and in his Mercedes, I think he is doing fine despite the risks he assumes. It's all about risk aversion. If people aren't willing to take care of their customers, even if someone IS taking advantage of them (which I would never do), they probably shouldn't be running their own business.

I'd say you do your best to run it in the way it should be run. From some of the comments you make, it doesn't sound like you are enjoying running your restaurant. Maybe that is a result of some of the decisions you've made regarding how to run it. That said, that's the beauty of running your own business - you are in charge and it doesn't matter what I think. Like you said earlier, it's about paying the bills.

I did a poor job of making my point, you stated my mentality was that of the "small time" business owner. My analogy was simply to point out that ethics are ethics, mistakes are mistakes.
Bottom line- the $$$ involved should not dictate how your ethics play out.
In your scenario of the store price tag, we have already assumed the pricing was in error. There is nothing dishonest about an error, and the store would certainly not be getting there kicks by intentionally getting peoples hopes up on a bargain, and then hope you pay full price at the register- as I said earlier- if you run into that and don't believe it was an honest mistake, by all means take your business elsewhere.
There is a big difference in accepting a mistake was made and crying foul anyway cause you don't WANT to believe a mistake was made.
F&C- my wife use to manage a Pizza Hut- more than a few times idiots would come in and put ground up glass in their pizza :rolleyes:- then claim it came that way from the kitchen.

When you pick up an item at a store, you have no idea what price the store intends to sell the item for OTHER than the price on the tag. You then decide whether or not you want to purchase the item based on what value you place on the item. If you value the item for more than the price, you have the money, and the stars are aligned, you probably buy the item. I would say this deals with ECONOMICS plain and simple.
If you switch the price tag from one item to another in an attempt to rip off the store, that would be an issue of virtue (or lack thereof).

These are silly examples we are all using anyway. The few times I have had this come up it was a difference of twenty dollars or less. My wife recently went to a store and was looking for a lego set. There was a sign advertising a set for a very cheap price. It was probably a black friday sale. At the register they shook their head, gave her the price without comment, and then called someone to have them go remove the sign. These are the real like scearios. And when you wait in line to buy an item thinking it's on sale only to find out is isn't, it doesn't exactly make you feel good. While my expectation is that I will get the price, I'm not going to go off screaming or something if I don't. But I'm also probably not going to buy the item and not likely to frequent that store anymore.

Husky, your starting to show a lot of common sense, which goes a long way in business dealings. As you pointed out most stores are more than willing to bite the bullet on a mistake and then correct the error ASAP.
There are plenty of good deals to be had, especially towards the end of the year, so I don't think it's necessary to question every bargain as to it's legitamacy. But every once in awhile if one comes along that appears way too good to be true, it pays to approach the deal with a hint of skepticism.
OK I'm done preaching, hope no one took offense, and here's to the bargain hunters finding the proverbial needle in the haystack.

i agree completely, while in college I worked at DICKS and at a local firearms store. If WE made a mistake, we would not hold a customer responsible for it. As for the ebay sale, obviously a brand new reel for 4.95, there was something wrong with it and to me it seems that using the buy it now without a question to the seller kinda means you were willing to capitalize on ones mistake. either way im glad it got dropped voluntarily as its really not a big deal, and ultimately as far as ebay there was no case

Birth in December is perfect for the following reason:
1. IRS Tax Credit, which equals more money for fishing stuff right before the opening of the season
2. Off Season to earn brownie points, you won't have to wrestle between going fishing and helping your wife. There are no fish!!
3. Summer time when baby is 6months old, you can go vacation as family to the beach! you can fish when they are sleeping...
I have put much thought into this and hence timed the conception exactly to the milli-seconds! J/K...
I'm getting fixed after this one, snip snip! :eek: next one is going to be adopted or no more for us... :)

So I was perusing eBay today, and came across a new in box Stradic 2500FH. It was on sale as a Buy It Now for $4.99. Yep, that's not a type, $4.99. I immediately bought it, and now the seller if refusing to go through with the deal, refunded my money, and will not answer any more of my messages. He says it was a mistake on his part, that he was interrupted while posting the item, and not I'm more or less SOL. I've escalated it through PayPal, but do you guys think I'm being unreasonable? The item was there, fair game. I paid for it right away and did everything according to what you're supposed to do.

renigs on an item he has won on auction. so i feel the seller should have to pay a small penalty for this mistake that he made.

So I was perusing P&S today, and came across a thread in the lounge(eBay Auction Problem...opinions please...). It was on track for awhile but as it is now its f%&ked. Yep, that's not a typo, over 200 posts. I immediately thought it was hilarious , and now the members are refusing to keep the thread on track with the issue, constantly reliving p&s 2007 , and will not answer any more of the original questions. it was a mistake on his part(basstardo), that he was interrupted while posting on the thread , and not I'm more or less SOL. I've escalated it through P&S, but do you guys think I'm being unreasonable? The thread was there, fair game. I posted on it right away and did everything according to what you're not supposed to do.:D:D:D:D

Rum and Coke is the shiznit! My fav. way to drink it is to get a 20 oz. bottle of Coke, pour out half and fill the rest with Capt. Morgans, drink and enjoy! Last time I did the bottle-2-bottle drinks I did it with 1 liter bottles and it was an awesome night. Don't know about anyone else, but I can drink that stuff all night and not have a hangover. Happy New Years!

You should go to Sunglow and use nightcrawlers on a doubledrop steel rig with treble hooks. Make sure your rig is a Zebco on trolling rod. That's KZ's secret to catching those sheepshead.

Tried that at Sunglow yesterday, but used a Pinecone instead. Did catch a nice bass though!!!:D
