This a new one for me. Wife and I got a summons to be a witness at a civil suit at Calvert County court house Thursday.
Man who owned the house next door sold it and held the lease. He foreclosed after the people failed to pay him for several months. (do not know why he waited so long) When the people left they stripped the house washer.dryer,freezer,microwave, and just about anything that was tied down. I asked them what they were doing and when they said that the stuff was thirs and they were taking it I said "okay" and went inside to call the owner of the house. He asked why didn't I stop them I said that it was not up to me I called him so he can stop them.
We went inside the house and it was trashed, It cost 50k to get it back in shape so he could resale it.
He is sueing and I am a witness. :--|

Hear no evil, see no evil, speak no evil. But you did tha right thing calling the owner. Just a victom of circumstance ..Good luck with that one, I hate going to court also..:eek:

You did the right thing in calling the owner. If people like that are willing to trash a house and walk out with appliances and things they know are not theirs, you attempting to get in their way could have provoked them to do something crazy. As if stealing someones stuff isn't crazy already.

The owner should win a judgement against the people pretty easily, but collecting from a bunch of deadbeats will be the hard part.

From what I understand this is not the only one that was done this way.
Sad but the owner told me that they also have a couple more cases against them this guy was the wrong guy to mess with.

what is he going to sue them for? they obviously dont have money if they couldnt pay

I use to be a licensed Real Estate agent and if I read this correctly, he sold them the house and all the appliances..well when he foreclosed they can take anything that is not a permanent attachment to the house which appliances are not permanently attached..except the stove which by law must remain . he can only foreclose on the Real Estate property not personal belongings...now as for the damage he may have to go through insurance for that...this case could go either way but I am thinking he will come out on short end...now if he was only renting to them and they walked out with everything it is a completely different story and he may have a case

According to the contract it was something to do with if they were foreclosed on they would leave everything as is. They went to court before and they agreed to pay so much down and 500.00 amonth. They didn't follow through on that and did not pay a thing so now they are back in court.
all the rest I do not begin to understand.

Over the plantiff got 105k.
Strangest setup I have heard of.
1. The owner holds lease to the house and
a. The buyer signed a contract that should he default on the payments he would leave the house and items within the house as it was when he purchased the house.

2. He paid for a couple months and went 10 months without paying.

a. It went to forecloseing and the buyer filed bankruptacy and did not show for that.

It goes on and on I could not believe it. The guy showed up for court without legal counsul. He told the judge that he thought it was just a hearing before going to trial. The judge said "If you had checked with legal you would have known."

There were mistakes on both sides and the judge just shook his head..

In MI they call it a land contract sale...work when you have bumpy credit, short time on job,etc...lots of sales up there go that way...hope your neighbor gets his money back...
