We really have no idea what they would try to capture in any new "fairness" doctrine. This is not the same world that existed in the 80's when the previouos one went away. My speculation is that a revival would go for ANY effective means of communication... which in 2008 means the Internet almost more than any other medium.
The argument for "fairness" being legal and constitutional is this: the broadcast medium is limited, we can't all use it in unlimited and uncontrolled fashion because there is not enough space in the electromagnetic spectrum. Therefore the Feds have gotten away with licensing use of the airwaves and prescribing broadcast content standards. No such regs are allowed on printing presses... we can all have one of those if we wish to speak politically (while the rest of the planet is using electrical-digital means).
Listening to Chuck Schumer talk about "fairness" makes me an angry and bitter man. Chuck speaks with forked tongue.
