for not having a seat belt on...........

Funny thing....I had my seat belt on from the time I left the drive way until 1.5mi later when he pulled me over.

Oh well. You win some and ya lose some. I lost this one. Im just floored that I actually had it on and got a ticket for it. I sherriff passed me not 100yds up the road from where the NC State Trooper was sitting. I didn't argue with him, as I figured somehow he could find something else to write me up for if he was going to cut into traffic to pull me over for a seat belt violation (or lack thereof:rolleyes:)

I figured he pulled me over for a head light or tail light or something being out (which none were) but you never know sometimes. He was polite, so was I, but I couldn't believe I was getting a ticket for something I hadn't done wrong.

I was going under the speed limit as well. Oh well. Just needed to rant.:mad:

I know there is nothing I can do. Courts will be on his side. His word vs mine. I have the upmost respect for the LEO's and their dutys but this one stumps me. I know everyone makes mistakes, but at 7:30 in the AM, main highway, was it worth cutting into traffic to give me a seat belt violation ticket........that I wasn't violating? Seems like even upon his suspicions of a seat belt violation, there would be bigger fish to fry (speeding, the guys that run off into the grass to go around somebody stopped to make a left hand turn with traffic coming, etc). Oh wellllllllllllllllllllllllllllllllllllllllllllllllllll.

I also got a ticket a while back for a seat belt violation.

I was driving my wifes car and she has both shoulder and lap strap that are connected.

What I did was unlatch the shoulder strap while wearing the lap strap only.

I could not believe that I got a ticket for this. I read my sons police manual and the regulation said that if a vehicle is equipped with both shoulder and lap seatbelts both straps must be worn.

I promptly mailed in my check. This lesson costed me 110 dollars.

The lesson I learned was to not drive my wifes girly little car and to stick to driving my truck:D

Yes I had it on, that's why Im confused and mad.

Regular belt, retracts from the shoulder side with belt across the lap. Had it on as normal and in plain view as could be.

from my exp. most cops think they see a seatbelt violation and pull ya over, depending on there day if you got it on, they might have just thought you didnt and give some bs warning, but others assume you got caught and quick slipped it on and they just didnt see it and write ya up for it anyways. sucks though, not a whole lot you can do. curious tho what color shirt and what color is the seatbelt? sometimes you cant tell till you are right on them.

yellow shirt, dark gray seat belt. right across the shoulder. he could have saw me coming head on pretty much from where he was sitting, the truck shouldnt have hid it, if it did.

I'd fight it in court. Ya never know, people DO win these types of cases, I'd say you stand a 60/40 chance of acquittal.

oh well...im going to install a simpson racing harness........after all I live 10min away from Mooresville NC where Simpson world and the rest of the NASCAR world are located. I know for a fact that it wouldnt be mistaken that I didnt have that on.

I once got a seatbelt ticket from an officer on a motorcycle.

I'm very respectful of police officers, but I thought that it was crazy that I could get in trouble for being in a motor vehicle without a seatbelt, when his motorcycle didn't have any such thing.

I guess that is just my luck.

Agreed...then again usually when I say something...I usually end up in cuffs for verbally asaulting a leo...I know the laws and I know them very well...3 of my very good friends are cops, my father was a cop, my mom was a cop, my brother is a cop. And when they spew their crap I spit it right back at them with codes and statutes and they HATE that! They hate people knowing the same stuff they do, if not more, in some cases. But thats the way the ball bounces. My brother tells me to be nicer to them and stop making him look bad, I'm like then tell you fellow officers to get their act together, and stop giving me grief for no reason. If I did something wrong, whatever, I messed up, I gotta pay the price, but don't harass me for no reason, cause I will throw the law back in your face, and they HATE that with a passion!

perhaps this is why he was given the ticket in the first place. towns, cities, counties, and states are hurting for revenue and tickets are one way of getting some!

A little update.....

2 days later my superior at work was pulled over for a tail light that was out....same trooper and same older gentleman (must be a rookie) was with him, he got off with a warning 10mi away

last friday 15mi away, same trooper pulls over co-worker's niece, gentleman in the passenger's seat. girl gets pulled for seatbelt violation, going 65mph down the four lane (that IS the speed limit), with tented windows (within the law). turns out it was on, but she had the shoulder strap behind her back, so she got a ticket for improper wearing of the restraining device.

2 days later, said "niece's" grandmother is pulled over for something and was let off because she was an elderly lady. same trooper, apparently the same guy riding shotgun with the rookie.

OH and by the way, I have about 10 sets of those race harnesses your looking for. They might be a little Smoke..y.;)

i would get everyones experiance with the trooper in writing, ie let off, gota ticket etc with the name and bday of each individual, when you make your case i would base it on discrimination because it was the elderly(no offense here) were given special treatment.
just my 2 cents and it may make the dept look into the troopers prior tickets and maybe establish a pattern.

haha well I doubt I could get off since each time the trooper had a vetern of the force with him.

Kim Adkins was his name, court date is June 5th I think
